This Privacy Policy describes how Darnd Inc. ("we", "us", or "our") collects, uses, and shares information about you when you use our Whim mobile application ("App") and related services. By using the App, you agree to the collection and use of information in accordance with this policy.
1. Information We Collect

- Content: Images and videos you upload for AI processing
- Transaction Data: Purchase history, credit balance, and payment information (processed by our payment providers)
- Communications: Messages you send to our support team
- Preferences: Your age range and content preferences collected during onboarding

- Device Information: Device type, operating system, unique device identifiers
- Usage Data: Features used, interaction patterns, timestamps, and session duration
- Performance Data: Crash reports, error logs, and diagnostic information

We use the information we collect to:
- Provide, maintain, and improve our AI image and video generation services
- Process your transactions and manage your credit balance

3. AI Processing and Third-Party Services
When you use our AI generation features, your uploaded images are processed by third-party AI services. These services receive your images solely for the purpose of generating your requested content.

Your images are processed by third-party AI services to generate your requested content. These services are located in various countries, including the United States and China. Your data may be transferred to and processed in these countries, which may have different data protection laws than your country of residence.
We select AI providers that maintain appropriate security measures. These providers receive your images solely for processing and do not use them to train their AI models without your consent.

- RevenueCat (USA) - Subscription and in-app purchase management
- Mixpanel (USA) - Analytics and usage tracking
- Sentry (USA) - Error tracking and performance monitoring
- Apple/Google - Payment processing through App Store and Google Play
Each third-party service has its own privacy policy governing how they handle your data. We encourage you to review their policies.
4. Face Data and Photographs
Our App allows you to upload photographs that may contain your face or the faces of others for AI image and video generation. This section specifically addresses how we handle such images.
What We Collect
When you use our AI generation features, you may upload photographs containing faces. These images are voluntarily provided by you from your device's photo library.
What We Do NOT Do
We do not perform facial recognition or biometric analysis. Specifically, we do not:
- Extract or analyze facial geometry or features
- Create facial templates or biometric identifiers
- Use face data for identification or authentication purposes
- Use your images to train AI models
- Sell or share your images for advertising purposes
How Face Data Is Used
Your uploaded photographs are used solely to generate your requested AI content (such as artistic style transfers, effects, or animated videos). The AI processes your image as a whole to create the output you requested—it does not isolate or analyze facial features.
Third-Party Processing
Your photographs may be shared with third-party AI service providers located in the United States and China for the purpose of generating your requested content. These providers process your images solely to fulfill your generation request and do not retain your images after processing is complete.
Storage and Retention of Face Data
- Input photographs: Stored temporarily in cloud storage (United States) during processing, then automatically deleted immediately after AI processing completes (typically within seconds to minutes).
- Generated output: Stored in cloud storage (United States) until you choose to delete it. You can delete individual generations at any time through the App, or delete all data by deleting your account.
Your Control Over Face Data
You have full control over your photographs and generated content:
- You choose which photos to upload—the App never accesses your photo library without your action
- You can delete any generated content at any time through the App
- You can delete your entire account and all associated data through Settings
5. International Data Transfers
Your information may be transferred to and processed in countries outside of your country of residence, including the United States and China. These countries may have data protection laws that are different from those in your country.
When we transfer your data internationally, we take steps to ensure that appropriate safeguards are in place to protect your information and comply with applicable data protection laws.
6. Data Retention
We retain your personal information for as long as your account is active or as needed to provide you services.
- Account Data: Retained until you delete your account
- Generated Content: Retained until you choose to delete it. You can delete individual items or all content at any time through the App.
- Transaction Records: Retained for 7 years for legal and accounting purposes
- Analytics Data: Retained for up to 2 years, then aggregated or deleted
7. Data Security
We implement appropriate technical and organizational measures to protect your personal information, including:
- Encryption of data in transit (TLS/SSL) and at rest
- Secure authentication and access controls
- Regular security assessments and monitoring
- Limited employee access to personal data
However, no method of transmission over the Internet or electronic storage is 100% secure. While we strive to protect your data, we cannot guarantee absolute security.
8. Your Rights and Choices
Depending on your location, you may have the following rights:
- Access: Request a copy of the personal information we hold about you
- Correction: Request correction of inaccurate or incomplete data
- Deletion: Request deletion of your personal data
- Portability: Request your data in a portable format

9. California Privacy Rights (CCPA)
If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA):
- Right to Know: You can request information about the categories of personal information we collect, the purposes for collection, and the categories of third parties with whom we share it.
- Right to Delete: You can request deletion of your personal information, subject to certain exceptions.
- Right to Non-Discrimination: We will not discriminate against you for exercising your CCPA rights.
We Do Not Sell Your Personal Information. We do not sell, rent, or trade your personal information to third parties for monetary consideration. We share data with service providers solely to operate and improve our App.
10. Children's Privacy
Our App is not intended for children under 13 years of age. We do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will take steps to delete that information as quickly as possible.
